Processing of personal data

Poelman c.s. B.V. ("Poelman c.s.") is a law firm located at Frans van Mierisstraat 50d, 1071 RV Amsterdam (Chamber of Commerce registration number 17217106). With this privacy statement, we inform you about the possible processing of your personal data.

We process personal data of our clients. This includes names, contact information, and other data relevant to the execution of the assignment. The processing of this personal data is necessary for the performance of our services. The purpose of the processing is to properly represent the interests of our clients, provide them with information, and also for invoicing purposes. We receive the personal data from the client or third parties, which may relate to (representatives of) clients as well as third parties. To maintain contact with our clients, we also process contact information of our clients or their employees. For this processing of personal data, we rely on the legal basis of the performance of the contract as referred to in Article 6(1)(b) of the General Data Protection Regulation ("GDPR"). In other cases, we process personal data because we have a legitimate interest in the performance of the contract with our client, as well as maintaining contacts with (potential) clients, as referred to in Article 6(1)(f) of the GDPR. In this regard, we have determined that the infringement on the privacy rights of the data subject is not of such a nature that we should refrain from processing.

We retain personal data processed in the context of our services for a maximum period of 20 years after termination of the client relationship or closure of the file. This is necessary to defend our legal position if necessary (Article 3:310 Civil Code).

Poelman c.s. may need to share personal data with third parties in the context of an assignment, such as in a judicial procedure. Poelman c.s. has a legitimate interest for this purpose and has determined that the infringement on the privacy rights of the data subject is not of such a nature that we should refrain from doing so. In certain situations, the law may also require us to provide personal data to third parties, such as authorities. Poelman c.s. uses vendors who process personal data on our behalf and under our responsibility for the systems we use in our activities (such as office automation, document management system, and invoicing system). In order to protect your rights, we have entered into a data processing agreement with these service providers, which complies with the requirements set forth in the GDPR. These vendors ensure that the respective personal data remains within the European Economic Area.

Under the General Data Protection Regulation (GDPR), data subjects have certain rights, in particular:

  • Access to personal data.
  • Rectification of that data.
  • Erasure of the data.
  • Objection to the processing of data.
  • Portability of the data.
  • Filing a complaint with the Data Protection Authority.
